Causing death by careless driving whilst under the influence of drink or drugs- Case Example G

Following a collision with a person who was lying in the road Mr S was charged with causing death by careless driving whilst under the influence of drink or drugs.  The collision occurred on a poorly lit section of road on a trading estate during the hours of darkness.  


After a site visit both in daylight and during the hours of darkness a report was prepared by BAI.  A number of issues were raised relating to visibility.  At the end of a trial at the crown court the jury failed to reach a decision and was discharged.  The prosecution discontinued the case against Mr S of causing death by careless driving whilst under the influence of drink or drugs but accepted a plea to driving a vehicle under the influence of excess alcohol.
