Using a vehicle in a dangerous condition - Case Example F

Mr. P stopped whilst driving a flatbed goods vehicle loaded with roof trusses that projected rearwards but not marked in the prescribed manner, his vehicle was accompanied by a van displaying an amber light.  The prosecution alleged that the vehicle was overloaded but never weighed, following an examination of the vehicle, and calculations based on the weight of the load it was shown that neither the axle nor the gross weight of the vehicle had been exceeded.  The court found that there was no case to answer and dismissed the charge.
